Ticket Question CA22349 VC - Ex. of 65 MPH
Ok got the citation, *** thought I was going 75 when a ******* green explorer was passing me. Thought the cop was in a hurry as he gets behind me. Follows me for a couple of mins, then as I attempt to go twoards my exit, he hits the lights and rolls me up.
Well... Ask him what was I doing wrong? He asked me what I thought? I said nothing, execpt going to work on a saturday. He chuckles and says any idea how fast you were going. I said sure, about 65 - 70, give or take a few miles cause of the hills and cruise control. Well he says... I clocked you at 75.. and are you aware the what the speed limit is? (Im like wtf...)
So I ask? Are you sure? There were cars passing me, can you have been mistaken?
He replied, sir, please hand me your liscense and registration...
go through the rest. He take 15 mins to write the f'in ticket.
Anyway, that was about 2 months ago. As soon as I got the ticket I noticed that he didnt put his name, or ID number on there. Is that a basis to challenge?
If I have to Ill pay the damn 260 (couldnt believe that ****, ******* traffic school is 300! ? Damn its been 4 years sense I get a ticket and prices jump that much?)
Any advice? Challenge ? or just pay / traffic school?

If you decide to fight the citation it's ok as long as the officer issuing the citation doesn't show up,then you win the case.in the other hand if he shows up(YOU ARE FUCKED),but then again what do I know.

odds are im going to pay. haha.. thats not my concern. he didnt put his name on it. I just wanted to see if any other brave souls who had an instance where something similar happened. (ie: cop didnt put name on ticket... went to court, no officer could challenge back, boom.. no fine)

Basically, your only hope to get off with no $ out of your pocket is to plead not guilty, go to court, and hope the cop doesn't show. That his information didn't come through to your copy doesn't change anything. By signing the ticket, you're promising to appear at the arraignment on the 29th to plead guilty or not guilty that has nothing to do with the cop. The interesting part is with no identification for the cop, who do they subpoena to appear at your trial? If you want to play that angle, be sure and schedule your trial for as soon as possible. Say as little as possible and DO NOT waive your right to a speedy trail (45 days max) so they have the least amount of time to notice his information is missing and then start calling around to find him in time. However, to be honest, I have little doubt they'll find him in sufficient time. Further, it doesn't sound like you can use any speed trap defenses in your situation.
The $300 should INCLUDE your $260 fine with the difference a BS court referral fee for traffic school. You still have to pay for the school itself which should be something between $25 and $40.
If I were you, I'd forget about going to court and simply go to the court clerk window and ask for traffic school since you're apparently eligible. If you plead not guilty, go to court and the cop shows up (and you will loose if he does), your chance of getting the judge to grant traffic school at that point is much much lower. You could still get it (I have) if you're lucky enought to get a good guy judge. But the primary point of traffic school is to relieve the backlog of court cases. So at that point traffic school does no favors to the courts workload.
