I really suggest you fight this one. I sure would. I'd love to hear how you could have a rolling stop and at the same time allow the SUV to pass through the intersection. And, if you think it's your hair that is drawing undue attention, I suggest you put on a hat before you get behind the wheel.

but even if u say that, the judges always seem to be on the cop's side and cops will bring big **** pictures to court. im not saying that its impossible to win, im sayin that its not a piece of cake

But, considering the SUV, in this case Dave will have simple logic on his side. Just need to have the cop give testimony that there was indeed a SUV. Also, Dave has a 3rd party witness in Anjew who can also witness there was indeed a SUV and that since Dave was behind him he SAW Dave stop behind him and wait for the SUV to to clear the intersection. Anjew doesn't have to worry about being questioned about his rolling stop as he isn't the one on trial there. And in the unliklyhood he is asked, as far as he knows he did stop completly.

Dave and Anjew go to court dressed like they're going to Church to show respect to the Judges court, present a foundation of logic supported by a 3rd party witness should absolutly overcome any bias the court may have.

After that win, to for sure put the cop in his place (read if you really want to give pay back) and help protect from retaliation since Dave lives in the area, have a meeting with his traffic supervisor. Lay out the story, that the ticket was given was of questionable nature, that the court agreed, that as a result you're absolutly concerned about retaliation recognizing the cops questionable attitude, and ask that he do what necessary to make sure that doesn't happen.

dave would rather pay $120 than waste a day in court. dave will do trial by declaration, and submit testimonies by himself, anjew, fris, and tony... and if that doesn't work, just look at the ******* security tape from the damn cop car!!

i actually went to court today over that bullshit back in june.

all charges dropped--including the u-turn because he fucked up on the vehicle code violation number.

now i'm looking for a lawyer to handle the harassment lawsuit imma stick on victorville pd. what kind of a moron arrests someone and cites 9 violations and has every single one of them dropped, including the arrest?

another a positive note, my public defender was a hottie. i think she liked me

Trial by declaration

Well, a measure of payback just by following that approach as well. Cops get paid for sitting and talking in the air conditioned courtroom.

Interested in FU's view. But, my understanding is, given duty shifts, it is difficult for cops to find time while on the clock to compose their own declaration. Bottom line, most cops HATE trial by declarations as they are a comparative pain in the *** for them.

I wouldn't care. Most agencies have full computers in their cars so it really takes no effort to write these days. It might be a nice needed break from patrolling in my opinion.

Remember this, 90% of peace officers HATE enforcing traffic laws.

If it looks like it came off the set of the Fast and the Furious then you have to accept that Cops will be more likely to pull you over (as wrong as that may be). Maybe they already heard your exhaust and so were looking for a lame excuse to pull you over.
