I would even be willing to pay your or trade you parts for the time, kindness and effort. Here is a copy of the complaint if you wish to learn more. I posted to several websites that i was looking for a T-56 transmission
and to email me with what you have. I have recieved several emails from
various people, including Jeff XXX. I wanted to find the best deal,
lowest price, low miles, etc, and Jeff had a T-56 transmission from a
2001 WS6 with about 28,000 miles on it. He was wanting $900.00 shipped
which included the wire transfer fee. We made a deal for a few other
parts he had, for $50 more dollars. The total was $950.00 for the
transmission, bellhousing, ripper shifter, power steering pump, air
conditioning pump, misc brackets, etc. We made the deal for the extra
$50.00 that i sent him over the phone, once he told me he had extra
stuff. I made the wire transfer via Bank of America to his bank on
07/01/2005. I waited for the transmission to arrive, which he said it
would take 4 days. I called him 07/07/2005, to see if he had a tracking
number for it. He told me that i never called him back, so he didnt think
i wanted it. He said he would send it out on 07/08/2005 via Forward Air.
On 07/15/2005 i called him and told him no transmission and asked him
again for a tracking number, he said it was at home and he was selling a
motorcycle and delivering it to Florida and will be back, the beginning
of next week. I called him later on 07/15/2005 no answer, left a message.
I then called him on 07/16/2005, no answer, left message. I called him on
07/17/2005, no answer, left 2 messages. I have emailed him several times
during these last 2 weeks; 07/08/2005,07/11/2005,07/13/2005,07/17/2005
(twice). He has not responded to any of my phone calls or emails and
still there is no transmission. I have called Forward Air to find out if
anything has shipped from that address, or the closest station to kansas
city, and she said just some electronics. I have done some research on
his email and username and hes on 2 different website, one of them
showing if the person is "online" or "offline". He was online a couple of
times this weekend, so i know he was home, or at least getting his
emails. I have emails proving this transaction, a few pictures of
the "claimed" items, a statement from Bank of America, the wire transfer
paperwork, and can prob get the cell phone records. If you need any more
information, please let me know.

I copy/pasted what your post on Dallasimports.net
Lots of domestic/import guys on there from all around the DFW area, so hopefully that will help. Any more info you can provide me to provide to them is always good.
Sorry to hear about this bro, I bought my motormounts off you. It seems like all the good sellers get the shaft eventually. =/

I would've gone and talked to him for you...too bad I'm a few weeks too late and am now all the way in Hawaii and won't be back for a few years. I hate people like that. Still have to pay a guy in Michigan a visit sometime so I know how you feel.

First, I'm not a lawyer, contact one immediately. It's over $500 so it's beyond small claims court. It's also across state lines so can be federal. It may even constitute postal fraud, involving the postmaster general. I'd do these things right away. It also wouldn't hurt to contact the fraud departments of each bank involved in the transaction and get their help on getting records, etc. for your own use. His bank records will likely have to be subpeonaed by an attourney once charges have been filed.

Small claims court limit is actually $5000.....it's how I was able to bring an insurance company to its senses and get a $4700 settlement for my totaled 1980 RX-7 from the chump's insurance company...problem is, he'd have to file and appear in a Dallas County court....

Are you sure he'd have to file in Dallas County? I always thought they just had to be served but could be filed in either location. My logic here is why make it more inconvenient for the plantiff. Again, like I said, I'm no lawyer and I don't even play one on TV. I've seen personally seen several cases where parties were in different states and the defendant had to travel to the plantif's court. Still, we're starting to drift off the topic of getting this nice gentleman his money back or the parts he was promised in the condition he was promised them in OR a severe public beating for the asshat here in TX. Personally I'd want both.

For Texas, it has to be in the county where the "crime" occurred....for me, since the accident happened deep in Grand Prairie, that meant it had to be a Dallas County court house. They, OTH, had offices in Detroit and in Delaware as third part insurers for the auctioneers. They would have been forced to send someone down to represent their company since the Dallas auction company that employed the old geezer for that unfortunate day, technically, was not involved. That's why you have insurance, right?
I'm still waiting on an Email from V8killr for info I lost three weeks ago and he's still waiting on anyone that is near this guy's address to drop in or at least get some pics of the house and area for him.
