All the rest are really my fault, since I travel a lot, and I'm not patient enough to sit there doing 65 for 200some miles, esp. at night. The road's so empty, the drive's so long, I'm so impatient lol, and I end up getting caught bookin it, all alone on the highway, at like 2 am lol (which is to be expected). I'm just thankful there's almost ALWAYS a way out, be it to get the ticket dismissed or reducing it. You should see the defenses I've put on...classic I tell ya. The judges just stare at me, or ask "Son, are you in law school or something?" LOL

But seriously tho, I'm trying to tone it down. Everything just seems so freakin slow at 70 lol. Not to mention, I'm always late to wherever I'm going, which certainly doesn't help me in obeying the law I know it's a self-control issue, and maybe it's my age, maybe it's my head, but I'm trying. The good news is my driving record only has 4 violations on it: failure to display both tags (cuz I just paid it...no points), the PA ticket which is "speeding generally" cuz it was reduced to 5 over, the dumb HOV violation, and an old 15 - 19 miles over speeding ticket (can't account for it lol)

turbodrx7, not to sound like a total ***, but I was thinking what Dave wrote. Sure, I have a nice long list, but mostly small and still negotiable stuff. Doing 100+ on ANY road is BEGGING for a ticket. Heck, if I saw a cop coming for me at 100+, I ain't stoppin until I had to, cuz either way at that point, I'm going to jail. And I couldn't complain about it either. That's way beyond pushing your luck IMO. I'm hoping you were just doing a quick run, not actually DRIVING at that speed???
Yes it was 1 run. The fastest i have ever had my car up to. For mabye a 1/4 mile then i backed off when i was coming up to the yet to be newly paved part and slowed back down to 60. At which point an Integra flew past me doing about 100.....Then i saw the cop coming up fast in the other lane. he flew up behind me to about my door. Slammed the brakes, ducked in behind me and pulled me over. He said if my car hadnt been so unique he would have never found me. And the fact that one of his friends that came as "backup" had a white 94, i suppose that helped But i dont normally drive like that. It was my first ticket since having my license and FD for 2 years. Yeah it was pushing my luck... And yes it was stupid... But everyone does something stupid once and while. And i got off easy. It was just plain scary that fast. Doubt i will ever do it again.

1) speeding, 79 in a 55---got it reduced to nothing (old FB)
2) cell phone, 1:15 am, leaving a club meet - $100 fine
3)exhaust, which in turn got me tints, no registration, and tried getting me on height?!?!?! --also reduced to nothing
4)"wreckless driving," pulled away from an intersection, tires chirped a little, spun a bit, then passed a cop, he spun around, pulled me over, asked my age and whatnot (i look like i'm 14), then told me to go on my way---again, nothing
5)speeding, way back to school...two lane road, speed limit 45, i was doing 70, when it switches to one lane again it's 55 (*** backwards upstate NY)-- gave me ticket for exhaust instead of speeding, also taken down to nothing :-D

thanks to my step-dad for getting me out of the tickets, minus the cell phone

wow...5 in one year isn't too good...and i'm 18 =\

Hey being a female car addict can leave you in the out group sometimes but is useful for getting outta situations you'd rather not take the time to explain. I stopped to make a call in a parking lot at like 2am and saw a cop driving over to investigate (yeah I'm out to rob Weis markets on the main road in a bright red sports car.) Rather than face needless questioning from a paranoid piggy, I just popped the hood and walked out. Cop got the deer in the headlights look. I told him the car stalled and flooded, yanked the fuse and cleared it (for good measure) and drove off with a relieved "Glad you know what you're doing" from the cop and no hassle. Always figured I could go the other way and play the dumb blonde role if I ever get caught for noise violation or something...what's a catalytic converter again?

turbodrx7, not to be hypocritical, but Dave's right. I stopped (ok I won't lie, just greatly reduced) doing my 140mph+ runs at night cuz it simply is too dangerous. You gotta rely on lightning fast reflexes and incredible car performance to make it as safe as possible, yet both of these variables are 100% reliant on one thing: your VISION. Visibility is horrible at best at night (just cuz you can't see what's out there doesn't mean it isn't there lol). I've had one too many deer jump out in front of me, and that's while doing 35mph on my way home. While I'm sure Dave wouldn't approve, I'm reserving my crazy urges for straight flat highways around here during broad daylight (less cops, better visibility). But then again, I'm tired of being a court frequent flier. Even if you win, it's a huge inconvenience cuz it takes all day, and some times (esp. in corrupt Fairfax County), it requires losing in General District Court since the judges are so damn horrible, and coming BACK and wasting yet another day in Circuit Court. Long story short, live long, road race less

I didn't say it, but I sure was thinkin it! I have a friend like that too. She just smiles, the cops make conversation w/ her, and that's that. MAN I wish I could work charm like that! lol

No tickets for me this year!!!! -------> I can't drive.........no license!!!
Well, atleast I'll get it back in March (I hope).

I lost my license for a year and a half because I "almost" outran a cop.
Yes it is ALWAYS a stupid idea but, believe it or not, I've outran a cop before in my 93 Geo Metro (5-speed).--->(I pushed that car harder on that backroad than I ever thought I could!!!--->I managed to jump that car about 8 ft in the air at around 80mph!!! Damn, did that hurt!!), then flew up a hill into a neighborhood and parked in a culdesac. Well, this time, I actually DID outrun the cop in my 89 Supra Turbo at 2am on yet another backroad (doing 125 mph at one point!!!) and after about 7 miles of chasing, I managed to pull into a driveway and cut my lights off. Well, the dog started barking at the house and I couldn't shut the car off because my starter was going bad and I was afraid that I wouldn't be able to start it back up without opening the hood and smacking the starter!! (I also had a really bad exhaust leak!!), so I left like 5 mins later in a different direction and got pulled over by a different cop further up the street because my car matched the description as "being a red sports car". The previous cop never got close enough to see my plate!!
That little stunt put me in cuffs as well as 12 fines!!
By the way, I ran because the car didn't look like a cop car, he NEVER turned his "lights" on, and the area I was in was in the middle of nowhere----> a place where I've NEVER seen cops before.......especially at 2am. So, when "this guy" started chasing me, I said "F*%K YOU!!" and took off!!

None, thankfully.... had a feeling I would while test driving my 1990 Yamaha Radian without tags, but it never came

Edit: Nevermind, that's a lie....

Been pulled over three times for driving with "expired" temp tags on my FC when I still had it around... lol, a couple of members in the NE section should be able to vouch for my uncanny ability to get out of deadly tickets....

Props to EAGE8 and the rest of the gang for driving in formation and trying to block that cop from getting to me out on 66 West near Front Royal...

Umm...you know there are two huge holes in this story, right? (that work FOR you). THIS is EXACTLY why I wish people read the laws and new their rights...to prevent BS tickets like this. But no, I'm not encouraging running from the cops lol.

This is in relation to VA law, so PA law may vary slightly:

- First, the officer must establish/identify 3 things for a prima facie case: 1) the vehicle that committed the offense, 2) the driver of the vehicle, and 3) that the driver was driving the vehicle at the time the offense was committed. There is some lateral play you have with these three things, namely in your case that the officer initially never got a license plate number or make/model, and later lost line of sight in the chase, preventing him from positively identifying the car in question.

- Another problem with these three points is that both cops MUST stand trial and testify, since identification (or lack thereof IMO) was dependant upon both officers. The one who spotted you first isn't enough, nor is the one who pulled you over later based on a vague discription. Both gotta be there.

- Now keep in mind that while these two points are rock solid in the eyes of the law (ie 100% valid), the judge can still find you guilty if he does not feel you've established enough doubt in the officer's word. Ie basically, if he feels you're lying, or thinks "hmm..what are the chances a red sports car was on the road in the same time" aka 2am? He can still screw you over. BUT, my point remains that from a strictly judicial standpoint, he should have no choice but to rule in your favor.

The other point that really concerned me was improper conduct of the officer who initially spotted you. I know for a fact that in PA, as well as in VA, speeding is considered an immediate danger, and immediately upon establishing that someone is speeding, an officer MUST light it up and pull you over. It's law. If he doesn't, he's conducted a faulty stop that's subject to complete dismissal of the case, esp. since you can argue you thought it wasn't a cop, and thus you are definitely NOT guilty of felony evasion.

Lastly, all these points and mistakes combined should very well cast enough doubt on the officers' actions to the point that the judge should have ruled in your favor. If he didn't, I woulda appealed it and taken it to Circuit Court or until you found a judge who basically wants to make sure things are done by the book, not someone who just wants to screw the sports car driver crowd (we have a LOT of those here in Fairfax County).

Dunno how much help this is NOW, but thought I'd let you and others know "in future reference" lol.

That's what happened in my ticket this summer - the place I remember being pulled over was 8 MILES after the violation, and no traffic. So he sat there for a while before catching up, and he closed on me doing about 100.

Problem is I didn't have enough recollection to prove that it was that far away, and I didn't know where to find this law documented. Care to share how a citizen like myself can get access to the full motor vehicle code and standard procedures the police must follow?

I got pulled over in Crenshaw County Alabama back in March of 04. That was my only "violation" My punishment? I'll be arrested on the spot if I'm ever in alabama for the next 7 years. Too bad cause of all the stuff alabama has to offer me. I've been pretty good about tickets lately. I've managed to go about 3 years now with no moving violations that I've been found guilty for.

abt 17 times since summer of '03
75 in 45 got off with broken speedo! wahoo!
96 in 65
65 in 45
91 in 65
84 in 65
50 in 35 (got off w/o ticket because i was trying to follow a friend who was being stupid, my first time @ UA
2x - passing in right lane
7x - no inspection
1x - drivers view obstruction
1x - no license copy in hand
1x - dead brake light
1x - unsafe driving
3 times i just got pulled over for suspicious driving:
twice in LBI and the third time i was driving out of the walmart parking lot at abt 3a.m. (on my overnight lunch break from ibm in fishkill) and i got pulled over by two state troopers then a cop suv almost pulling a drift maneuver parks in front of me with his brights on and after they asked me to get out of the car and stand at the back. there was another cruiser, and a state trooper in a pickup with a cap pulled up and asked them if they had everything under control, then after they knew me and what was on my record etc. they asked me if i had any drinks or meds, then let me go and said "we pulled you over because you were driving suspiciously" and i at that point said **** work went home and said man what a day n slept

18pts later, w/ a restricted license and no means of even going to the grocery store, lead foot (more like depleted uranium foot) does not even begin to describe my absent mindedness of law when i drive, i guess im just one of those hard way guys ::shrugs::

Dave, you know I'm a average citizen just like you too, right? LOL.

Honestly man, this stuff is from all over the place. First it started with hearing rumors about supposed laws and procedure, in which I'd randomly pick a cop I come across and ask him if a given rumor was true lol. Then I got bold enough to make routine stops to the regional police station haha. Only prob was, I wanted specific codes and their wording that I could refer to... Then I discovered the VA Motor Vehicle Code online. The prob is, it isn't organized by section or topic (or at least I haven't found it yet in such a format), so you have to search through it. They're making it hard on you to defend yourself on purpose I tell ya lol. Anyways, it can be found here: http://legis.state.va.us/Laws/CodeofVa.htm

The other thing I REALLY needed was the police policy and procedure handbook, which the police dept. told me "doesn't exist" LOL. What a crock...you tell me the ENTIRE police academy is strictly oral? I'm still working on that one, cuz that's where the gold is.

In the meantime, one of the best things that happened to me was the last ticket I got...the 85 in a 55. I pleaded it down to improper driving, given the ticket would be on probation for a year (so I gotta behave real well). But here's the good part: part of the agreement (a bargaining chip, basically) was that I had to take this "aggressive driver course" that's offered by who? You guessed it: The Prosecutor hehe. That's right...$150, two and a half hours, for three weeks. And MAN...this guy is a GOLDMINE. I make up a list of questions to ask him every week lol. Plus, part of the class is about telling us what the law is, what you have to do to proove your innocence, and of course how to ensure you don't break the law. But yea, he helps out a LOT. But I still gotta get that policy & procedure handbook...

Another good source are lawyers themselves. If you're keen on what they say during the initial consultation, you can always pick up a bit here and there - even though they're hesitant to share strategy. If you build a good relationship w/ them, they're a lot more forthcoming, and will even answer other misc. questions for you. With my lawyer, I actually discuss w/ him what strategy we're going with lol...it's a collaborative effort haha. He doesn't care since he gets his $500 anyways (Fairfax County Prosecutors won't talk to me cuz I'm not a lawyer, so big tickets there require me getting a lawyer to plead, if I don't think I can win).

As for you Dave, you're actually in luck. If you go here: http://www.dmv.state.pa.us/vehicle_code/index.shtml, it actually has Penndot's Vehicle Code, very nicely and neatly organized, plus it has a section that seems VERY promising: "Part V: Administration & Enforcement." While I haven't read yet, the fact that you have one is a lot more than I can say for VA. I'm sure there are at least a few goodies you can find from that part

Also, I want to attach a file (it's basically a short book in a word document, only 22 pages) written by a traffic lawyer, but it's too big . It's got a lot of nice tips and pointers, as well as some general strategies that you can tailor to your specific situation. Keep in mind it's written based on the most popular laws, so certain things may or may not apply to your given situation. But feel free to DL it, save it, and distribute. I found it on the net a while back... So if anyone can host that for me so everyone can download it, that would be great.

Last thing about this...always try and plead your case w/ the prosecution before the trial. Keeping your record somewhat clean is of PARAMOUNT importance. The hard part is knowing what chips a given prosecutor likes...some like aggressive driver programs, some like you to already have done a driver improvement program, some want you doing nothing first, some won't even talk to anyone who isn't a lawyer etc...and that's where lots of courtroom experience comes in handy. Basically, if you wanna take on the big dawgs AT THEIR JOB, you better know it just as good as they do.

Bob, you know my mom got this bad ticket a few months back, and the lawyer we had did a HORRIBLE job, but that was $500 too late...so I wanted to defend her myself...I tried EVERYTHING. I got a signed Power of Attorney and everything, notorized etc, and the court simply wouldn't allow it. You actually have to be a lawyer. Freakin pissed me off, esp since I wasn't about to blow another $500 on the ticket.

If all else had failed, we all know the Chewbaka defense would have gotten him off.
Chewbaka defense? I'm not familiar w/ that strategy lol... what's that look like/consist of? Destory & run? lol

Not a lot...but prob. just more than the average Joe Schmoe. I'll say it again: If you wanna take on the big dawgs AT THEIR JOB, you better know it just as good as they do. I don't think people realize what a HUGE disadvantage we're already in by not knowing the ins and outs of the legal and court system. Do you know that officers are TRAINED in HOW to testify (as to lend them authority and their word trust). Things are slanted soo far in their direction, it disgusts me. It's bad to the point that I think EVERYONE should be awarded an attorney by default...

Simple stuff makes a huge deal too...cuz in court, it's not about what you KNOW, it's about what you can PROVE. Some ppl get suckered into thinking your honest "I didn't do it" is worth anything. In fact, the judge has no choice BUT to rule against you in such a case, because you have absolutely NO evidence to support your claim, and well, that cop...he has a working relationship w/ him for prob YEARS now...

you really hate your town huh? LOL
Not town, my COUNTY. But I mean, I gotta Thank God...nothing's perfect. The other day, someone got shot and died in my County. The ENTIRE police force mobilized to focus on the case, cuz it's the only murder/violent crime we've had in sooo long. So I mean, it's a trade-off: super nice and safe county = awesome place to live in, vs. totally bored cops = horrible place to drive in.
