Did you have to go to court in person? I got a 73 in a 55 (leaving buxton in a jeep cherokee which barely even goes 70, don't know what i was thinking), the ticket says its a mandatory appearance in court. So I'm paying a lawyer to go in my abscence, $265 for the lawyer and a fine of $130-140, for 1 second of speeding.

yeah, you're supposed to be there... but I've heard that some courts are pretty relaxed with that... but I would probably contact the lawer about it, because he would probably know.

I'm going to double-check, but all 5 of the lawyers I called said I just sign a power of attorney and they can show up instead of me. My girlfriend hired a lawyer for a speeding ticket in the past also so she claims its perfectly legal.

Just to update this thread - I successfully paid a lawyer $265 to go to court for me in dare county nc, I didn't have to be there. She pleaded it down to 64 in a 55 instead of 73 in a 55, $120 ticket and no points.

Seriously! It was almost an even exchange when I think about what a pain it must have been for her to drive to court, stand there and talk to the judge, fill out paper work, write a check, and then drive home. I wouldn't do that for my clients for under $1000!

I still almost burst a blood vessel thinking about how ridiculous it was paying $405 total just for driving a little over the speed limit. Its such a racket! I better stop thinking about it...

Lawyer - priceless. Get one for sure. Im still digging myself out of a 2 year ongoing revoked licence and believe it or not....its not my fault. I know it sounds like bull however I got myself into the situation however negligance to communicate between law enforcement and the MVA and MVAs slowness to change records have postponed it this long and true to whats been said by FDnewb the court doesnt believe the lazy asses at MVA dont do there job and that officers actually care to communicate with them.

Theres nothing you can do on your own. Period.

Now, the Video Tape...NOT a bad idea, any photos or video even that you can produce is helpfull as instruction/education to the judge. Now your point shouldnt be that you were tached up rediculously hight. 5500-6000 is excessive regardless of the situation outside of a race track. 4000 Or close I think there is a chance for reason. Now HERES what no one has brought up yet.

YOUR LAWYER should be the one to deliver this info. If your in an FD which im assuming your in a bonified sports car. Obvously built to be faster than most vehicles. The second gear in your car, to be effective, I.E. not chugging along about to stall you would need to be going even faster than you were for normal operation in that gear. It stands to reason that the car is more easily controlled at a higher RPM in the lower gear instead of inproperly operating your vehicle.

Yes the car is loud, appologize however again thats just the way the car is built. In all honesty I dont think your judge would have a problem with you opting to operate your vehicle in a manner that restricts your speed in a parking lot at the risk of making a few people a bit uncomfortable with noise. I think they would be much more comfortable hearing a loud car than being run over by one.

Then again my experiance and knowledge of the legal system in Maryland comes from sitting in court listening to what Judges actually go for and deny. Just make it common sence and sound reasonable. If its obvious your trying to bull **** the judge then yeah....your **** out of luck. That does not mean you have to roll over for a judicial system that does not have deffinitions and/or discriptions sufficiant to satisfactorilly qualify driving behaviour....I would definitly not mention that last one though.

Well I ended up going to court and just took the cop's deal of knocking it down to imporper driving.. At the end of the day it cost me $106.. $50 for the ticket and $56 for admin fees.. No points or anything, so that was ok with me.

Lesson learned..

It does carry points. Either it does, and he got shafted (lol), or it's not improper driving; the cop reduced it to a "failure to obey traffic/highway sign," which is a non-motion violation, and doesn't carry any points.

Also, it's pretty rare for the cop to strike a deal w/ ya...must have been an older, mature cop who had some sympathy.

Actually the cop was probably like 27, or 28 at most.. I think he felt bad since he made me do all those sobriety monkey dances when I asked to blow into the breathalizer first.. I HAD a beer at dinner but it was a few hours before the incident.. so the cop made me dance, I danced, and then he gave me the breathalizer anyway, where I was at like a .008 and the legal limit was .8 .. Since I was a good sport about the whole thing and didn't argue, he struck the deal.. I sure feel shafted not to get any points.. *rools eyes*

I'm not trying to be difficult. But if the ruling was on Improper Driving, you WILL be assigned points, no if's, and's or but's about it. The Judge and Officer can say whatever they want until they're blue in the face, because they do NOT control the point system. The point system is run by the VA DMV, and they assign points to certain violations, and don't for a select few. So if the Officer told you you wouldn't be getting any points, but you settled for an "Improper Driving" ticket, you DID get shafted, because the DMV WILL assign those points to you. 3 points to be exact. So again, if the charge IS Improper Driving, you WILL be assigned points by the DMV. I have $20 that says that if you check your driving record in a month or so, you'll find 3 points assigned to that specific violation. If you have a Failure to Obey Highway Sign violation, then you DON'T have points. The laws and rules & regulations of the DMV are very simple. It doesn't matter what ppl tell you; the rules are rules.

Speed limit in parking lots is 15mph. In VA, going 25 is def. "flying" through. The cops around here SUCK!!! (in case you hadn't gotten the chance to notice yet)
