If that's the case, perhaps you could argue that you didn't actually modify the muffler. You simply bought a replacement and installed it. How should you have known otherwise?

As I said, my Apexi Dunk has not been modified.

If you read the thread, I quoted the statute the cop cited me for.....and there is no mention of modifications or size specifications. He cited (modified exhaust non-factory equipment 5 inch pipe) me for something that's not in the statute.

There's nothing in Florida Law that says it is illegal to have non-factory equipment on your car!

http://www.hsmv.state.fl.us/handbook...sh/ch_205.html

Just a couple links that mention this issue, but no real information.

Interestingly, the Florida state legislature and courts website has Florida Statutes online, but Chapter 310. Falls under boat/vessel codes (I think motor vehicle was 318-325), which doesn't make sense.

Unfortunately, in PA I tried looking for similar motor vehicle code, and basically the state doesn't share it with us. So for most of us, we always 'learn' the law by word of mouth. Truly sad, but not the cop's fault.

I dunno if this will solve all your problems but here ya go..

http://www.urbanimportonline.com/exhaustnote.htm

There are usually a lot of things you can do, like if you have something from the manufacturer saying its 50 state legal, show it to the judge in court, it works. I've told many friends to do it here in NY because here they dont need a decible meter they just listen and if it sounds to loud you get a ticket.

Most of the info on that site is directed at California laws because they have the strictest laws in the land...

Thanks for the links.......they are both interesting.

I would like to point out that the link to Chapter 5 in the FL handbook says that you can't have any smoke coming from your exhaust.......Whooooooooow!

I guess that'll take all of the rotaries off the road.

5" tip is illegal in CA (dunno about FL). I beleive the max is 4". Modifying can be the descretion of the judge. You are not modifying the exhaust from the state of purchase but it can be argued that by replacing the stock exhaust you are modifying the sound levels.

Most likely he was assuming you had warrants, no insurance, stolen car, etc and when he didn't get a juicy ticket in his mundane ruitine day he got pissed off and settle for what he could get. It makes no difference if the ticket is disputed unless his are routinely disputed.

Pretty much... Sorry for the BS ticket man. I just paid my no front tags BS ticket and was on my way. Big woop. Freakin lazy *** cops w/ nothing better to do...

EDIT: I didn't get pulled over for no front tags...in fact, he never even saw the front of my car since it was stop-and-go traffic. But he was standing perpendicular on the side, and well, umm...he pulled me over cuz I looked at him LOL. I swear. It was an ego thing... to the point that he walked around my car, looking for something to ticket me on THAT'S when he noticed I didn't have front tags...

Sorry if I bring this off topic but if Im going to rant a little damnit Im ganna...

Im sick of cops giving out tickets like this for such crap. Seriously there are 35k shootings a year in this country. I know cops deserve a lot of respect and they put themselves on the line a lot of the time but when the area I live in gets raided with car theft once a month I think the Boston PD can afford to either take one of the meter-maids handing out parking tickets or an officer who pulls me over for tints and my stock exhaust and move them up 3 blocks and watch out for the community. To be competely honest, and some of you will hate to hear this but the economy favors crime, i think at least. The city will get more by giving us worthless tickets than actually stopping real criminals and setting up stings for more serious crimes.

EDIT: I forgot to mention that the city of Boston makes more than $250,000,000 in parking tickets a year. 1/4 of a billion dollars. And yet my friends honda civic and honda accord get jacked like 3 times a year...

My .02 cents

Well...I'm between a rock and a hard place. The good news is, the county I live in is one of the richest in the nation, which translates to one of the lowest crime rates (w/ large populations). The bad news is, the worst crime we're lookin at here is teenagers w/ drugs or minor thefts. Nothing REAL big. And we have a HUGE police force. The result? They got NOTHING better to do, so they crack down on speeders like you don't know. Exhaust tickets, no front tags, turn signals that blink faster than one time per second (I'm serious lol) lowered cars, you name it. This county makes more than FIFTY PERCENT of it's profit in traffic citations alone. Where does the money go? Mustang, Impala, and Camaro highway patrols (the Camaro has a 100 shot of NOS, believe it or not, and a CF hood, to keep up w/ the racers lol), helicopters to catch speeders, and of course, a $94.5 million courthouse expansion construction project

Yea...Fairfax County is NOTORIOUS man. It's very well known by ppl who live in the area, and unfortunately visitors who mistakenly drive through LOL. It's just as bad here as it is in Cali, minus smog. We have emissions, and it's tough, but not nearly as tough as Cali. I do, however, think that our traffic laws are toughER than Cali's. For instance, a reckless driving ticket (20mph over the limit, or speeding in a school zone, or aggressive driving, whatever that may be lol) is as serious as a DUI - they're both Class I Misdemeanors, carrying a $2500 fine, 6 months license suspension, and up to ONE YEAR jailtime, if memory serves me correct. And you can bet your a$$ that the judges DEFINITELY do suspend licenses and throw ppl in jail JUST FOR SPEEDING. Even ppl w/ clean records. I've seen it myself.

Also, in Cali, speed traps are illegal. Here, they're the LAW lol.

damn

so like what do you do? i mean with your car? since cops know you (i assume), they let you pass on certain things like exhaust etc, or are you stock?

cause damn, if i was in your shoes, i prob would either move out or quit the game knowing you cant have any fun with cars since those cops are always knocking you down..

its scary how the law is being enforced like that throughout the country slowly by slowly..

they need something better to do.

What CAN I do? I just try my best not to get caught...that's all. I spend 98% of my time checking my rear view and scanning the cars up ahead for cops, all day, every day. I kid you not. And it's ONLY when I get sloppy/lazy that I get caught.

Thankfully, I don't think they know me (yet). There are so many cops, I haven't seen/been stopped by the same one twice. But I'm sure they'd recognize my car again if they saw it the first time. It's not exactly "stock" exterior I prob. shouldn't say this, cuz I'll prob. jinx myself, but I have one of the LOUDEST exhausts IMO (very deep drone/bass). It's the HKS CF Ti, w/ a 140mm tip or somethin. What's that...4" + I think? lol. But I have yet to get pulled over for loud exhaust. AAANND I have the PFC idle bounce thingy lol. I've actually pulled up to cops 3 times now, and they heard the idle thing, and didn't bother me, since I didn't look over lol. I was prayin they didn't think it was me trying to instigate them into racing or something. Also, you gotta understand that they def. profile guys like me...w/ exterior mods. A cpl of the other guys w/ FDs don't really have any probs cuz they're totally stock exterior gives the sense that they're older and hence more mature drivers I guess?

As for moving out, it's not really an option. My family's here. It's home If you talk to Wargasm tho, he'll tell you he SPECIFICALLY lives in MD to avoid dealing w/ VA and Fairfax County cops BS lol. Smart man...

He's right y'all... A lotta these roads are Under rated... I've taken em at 90 in the ******* pickup truck... I've got two friends both of which had or have minivans. (1999 Chevy Venture and 1992 Dodge Grand Caravan) Both vans have been overloaded and abused and as such have **** for shock absorbers (We had the leaf slprings on the caravan bent over backwards once.) and they both ahve teken the parkway at 75...

These roads are made for revenue. They've graded areas and put overpasses in just the right areas for cops to hide...

These are NOT populated areas...

On Speed of light's note, I suppose I am fortunate to live in a state with no-probable-cause law. In Alabama, a cop can pull you over just to say "hi", so that eliminates them giving you stupid-*** tickets to justify a stop. I have never known anyone around here to get a ticket for an illegal exhaust...

I used to drive my four-banger to the dragstrip with a 3" dump pipe coming out of the turbo, loud as ****, shooting flames and stuff... never got pulled over for that.

Actually, now that I remember, I once lost my rear section under the car doing a hard shift, and looked up and saw a cop behind me. My buddy and I pulled into the McD's parking lot (11pm, more cops there), and I jacked up my car, removed the exhaust, put the parts in his trunk, and drove away with just a downpipe hanging out of the turbo... cops watched the whole time, didn't give a ****...
Awesome.. Best thing I ever did was to MOVE to Alabama. Practically cops will give you thumbs up as you drive by.. LOL!

Yea? How you think I feel when I LIVE here?

is it like that in all of virginia, or just NOVA?
Well NoVa is the worst it gets. Other parts of Va are "the South," ie good old country boys, not many resources (financially) for those counties, thus not too many cops. Plus, the speed limit jumps up to 70mph on the highways, while the highest we have ANYWHERE in Northern VA is 55mph on 4-lane highways (compared to the 2 lane twisties in the rest of VA...where's the logic in THAT?!)

I was in the car w/ a friend of mine, coming back from UVA, heading toward NoVa. He caught pulled over doing 105 in a 55 in Rt. 29, and the cop simply wrote him a ticket. No jail, NOTHING. If that happened in NoVa, they'd cuff ya, take ya to the big house lol, release ya the next day, you'd stand trial a month or two later, in which case you'd go BACK to the big house for a longer period, and try and get a restricted license since your license would def. be suspended...

how bout WV?? even though theres nothing there hahaha, is it bad too?
West what? Where's that? lol

Yeah Northern VA is pretty bad... so is the southside of Richmond (Chesterfield county), the cops are plentiful and have nothing better to do than wirte traffic related tickets.

It seems to be better around the blacksburg/christiansburg area... like you said, it's "the south" and most of the cops seem to be fairly laid back
