well, my friend's car got stolen, so i had to give him a ride to work today. on my way home, some dipshit cut over from the right lane into the left lane right in front of me and slammed on the brakes to make a left turn. pretty much stopped in 45 mph traffic. i hit the brakes and they locked up at the last second and i hit him at about ~20mph. he took off and ran through the redline, and i ran through it right after him. called my dad on my phone, told him what was happening, he wrote down his plates as i told it to him. followed him though about 10miles of back roads (he was trying to loose me) untill he got stopped at a stop light. i got out and looked at my car, and went to his window and asked him what his problem was, and he tried to play it off like nothing happened. the light turned green and my dad called at the same time, so i told him to pull over in a neighborhood so i could talk to him about it, well the **** kept going, and my dad told me since i already have my plates, and i didnt know the condition of my car, to come home.
after i hit him, my car made this WEIRD noise, but my oil psi and water temp stayed normal, found out and heat shield some how got bent and was rubbing the driveshaft.
anyways, to the damage.. hole in the licence plate, both front turn signals are knocked out/cracked, my bumper went under his so i have scrapes on that, and my header panel is dented like crazy. so, if any of yall have any of those parts (perferably in red) and want to sell them to me.. PLEASE!!!
what are yalls opinions on legal action? my dad's friend who is a cop said even though its technically his fault, i wouldnt be able to prove it and i would get a ticket for following to close, plus raise my insurance. but im thinking since i had to follow him for so long, it was a "hit and run" even though i hit him. this really ******* sucks, and to top it off, while we were under the car looking at the driveshaft, we found that my BRAND NEW tokico blue on the driverside rear is leaking its oil.

Man, that really sucks! One thing though, he had to be embarrassed in his pitiful attempt to get away from a seven! Any damage to his car at all?

it was funny watching him try to take turns in his old cavalier trying to loose me, no chance, just glad he didnt slam on the brakes again.
*sigh* i guess ill figure somehting out, i dont think im going to report it because my insurance doesnt need to get raised. hopefully i can get some parts off a forum member or from a junkyard. ill try to get some pictures later.

i had a friend tell me a story about how some girl at a redlight backed into him on purpose so that he would be declared at fault, which he was, and she could have existing problems with her car fixed.

Geez! Accidents are terrible. I wish you the best with the repairs and any legal issues you may have.
Here's a story that might leave you feeling "not so bad":
A relative of mine was out in California on business driving down an 8-lane highway (one way is 8 lanes). He was in the 2nd lane in from the right. All of a sudden, he heard screeching noises coming from the passenger side of the car. The got louder and louder. He looked out the passenger window and saw a car flying towards him, perpendicular to his car. The other driver's car hit my relative's car (a Camry) and spun the Camry across 4 lanes of traffic doing multiple 360's. He ended up in the 2nd lane in from the left PERFECTLY straight going in the direction he was headed and hadn't hit any other cars. To make a long story short, the car was totalled and the guy that hit my relative was gone - hit and run. It's a miracle that he lived and that he didn't hit any more cars that day.

The fact that the guy left the scene of the accident really works in your favor, as it displays a sense of guilt on his part. I'd sue him, and leave the insurance people out of it, personally. -WG

I agree, with WankelGuy. I dont know what the laws are like there, but here if you leave the scene of an accident no matter whos at fault. Youre in deep ****. And just because you hit him from behind, doesnt nessicarly make it your fault. Ive got a story to go with everyone else's.

The one big thing I can see here that may cause you some problems is proof? I mean obviously the damage is clear and some paint might be left on your body etc, but, wouldn't you need some witnesses or something to really back up your claims? In australia it's almost guaranteed that if you hit someone from behind you are at least blamed %50 no matter what on most cases.... good luck though man, coz that really sucks what happened!

Fight it, I don't 'bout where your from but in kansas if someone passes you and suddenly stops it's their fault. Just hope that A$$hole had some paint from your car rubbed off on his car. I would report it immdeiately, because who's the judge going to believe, the one who reported it to cops and or the one who acts like the whole thing happened. I would find out where the jerk lives and brick out ALL of his windows.
Just remember to wear rubber gloves and burn them after the crime and dispose of them somewhere other than your house. And don't forget to do it so no one witnesses it, no edivence, No crime.

it wouldn't be hit-and-run, but it would be "leaving the scene of an accident", and yes, that would indicate guilt on his behalf, all this info would help you out in a court case. and yeah, I'd just take him straight to a civil law suit and sue him for damages...

Doit dood, bu if you really dont you could try and get his phone # or soemthing form his plate # adn call him and tell him if he wont pay for the damages you will see him in court.. worht a shot.

I'd say get someone you know, say they were in another car at the same time and seen what happened as a Witness, but when you go to report it, make sure not to mention that you know him/her in any way, and say you didn't report the accident right away because you were waiting for your witness (your friend) to call you back.

there'd be paint on the other guy's car if he went under his bumper, unless he was smart enough to use cut-wax on it.... and his dad could be used as a witness, like stated above.

In a Civil proceeding, if it's found that the event "most likely" did happen, a guilty verdict could be awarded. The case doesn't have to be proven "beyond a reasonable doubt", like in a Criminal proceeding.

it sounds to me like it's going to become a knock for a knock as you cant prove he was even there..
i know i sound harsh but thats the relality of it all :|
